1. Acceptance of Terms
By accessing or using the NOVEXA platform ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract. By registering, you represent and warrant that all information provided is true, accurate, and complete.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to keep it up to date. NOVEXA reserves the right to approve or reject any registration at its sole discretion.
4. KYC & Verification
All bidders must complete Know Your Customer (KYC) verification by submitting valid identity and address documents. Your account will remain under review until the submitted documents are verified. You may not participate in auctions until your account is approved.
5. Bidding & Auctions
All bids are binding and irrevocable. By placing a bid, you commit to purchasing the property at the bid amount if you are the winning bidder. You must have sufficient funds or financing in place before bidding.
NOVEXA reserves the right to cancel or withdraw any auction listing at any time without prior notice. Bid amounts are exclusive of applicable taxes, stamp duty, and registration charges.
6. Earnest Money Deposit (EMD)
Winning bidders must deposit the Earnest Money Deposit within the timeframe specified in the auction terms. Failure to do so will result in forfeiture of bidding rights and potential legal action.
7. Fees & Payments
NOVEXA may charge platform fees, transaction fees, or other service charges. All fees are non-refundable unless explicitly stated otherwise. Payment terms will be communicated at the time of transaction.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, images, and software, is the property of NOVEXA or its licensors and is protected by applicable intellectual property laws.
9. Limitation of Liability
NOVEXA provides the Platform on an "as is" basis. We make no warranties regarding the accuracy of property listings or the outcome of auctions. To the maximum extent permitted by law, NOVEXA shall not be liable for any indirect, incidental, or consequential damages.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy. We collect and process personal data in accordance with applicable data protection laws.
11. Termination
NOVEXA may suspend or terminate your account at any time for violation of these terms or for any other reason at its sole discretion.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi.
