Most bank property auctions in India happen under the SARFAESI Act, 2002. The law lets banks recover loans by taking possession of secured assets and selling them without going to court first.
For a bidder, the law is actually a safety net. It requires the bank to publish a clear auction notice, specify the reserve price, and issue a sale certificate once the sale is complete. The sale certificate is a crucial document, it becomes your proof of title.
There are a few points to watch. Always verify whether the borrower has any pending legal challenge against the auction. A clean title, a valid sale certificate and cleared dues are the three things that make a SARFAESI purchase safe.
When in doubt, consult a property lawyer before you commit your EMD.
